These Terms of Service (“Terms”) govern your access to and use of ForemanIQ's software-as-a-service platform. By using ForemanIQ, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using ForemanIQ, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use our services. If you are using ForemanIQ on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

ForemanIQ is a multi-tenant software-as-a-service platform designed for field service businesses. Our platform provides tools for customer management, project tracking, proposal generation, photo documentation, scheduling, and business reporting.

3. Account Registration

To use ForemanIQ, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years old
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription Plans and Payment

4.1 Subscription Plans

ForemanIQ offers various subscription plans with different features and user limits. Plan details and pricing are available on our Pricing page.

4.2 Payment Terms

  • Subscription fees are billed in advance (monthly or annually)
  • All fees are non-refundable except as specified in Section 4.4
  • We may change pricing with 30 days notice
  • Failure to pay may result in service suspension

4.3 Free Trial

We offer a 14-day free trial with full access to Professional plan features. No credit card is required to start a trial. At the end of the trial, you must select a paid plan to continue using ForemanIQ.

4.4 Money-Back Guarantee

If you are not satisfied with ForemanIQ within the first 30 days of your paid subscription, contact us for a full refund.

5. Acceptable Use

You agree not to:

  • Use ForemanIQ for any illegal or unauthorized purpose
  • Attempt to access other users' accounts or data (other tenants)
  • Interfere with or disrupt the platform's integrity or performance
  • Upload malware, viruses, or harmful code
  • Scrape, crawl, or use automated means to access ForemanIQ without permission
  • Resell or redistribute ForemanIQ without authorization
  • Use the platform to send spam or unsolicited communications

6. Your Data

6.1 Ownership

You retain all rights to the data you enter into ForemanIQ, including customer information, project details, photos, and proposals. We do not claim ownership of your data.

6.2 Data License

You grant ForemanIQ a limited license to use, store, and process your data solely to provide and improve our services.

6.3 Data Export

You may export your data at any time through our platform's export features. Upon account cancellation, your data remains accessible for 30 days.

6.4 Data Responsibility

You are responsible for the accuracy of data you enter and for obtaining necessary permissions to store and process your customers' information.

7. Intellectual Property

ForemanIQ and its original content, features, and functionality are owned by ForemanIQ and are protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without written permission.

8. Third-Party Services

ForemanIQ may integrate with third-party services (payment processors, email providers, etc.). Your use of these services is governed by their respective terms and policies. We are not responsible for third-party service availability or performance.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We are not liable for service interruptions beyond our reasonable control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOREMANIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF FOREMANIQ SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless ForemanIQ and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the platform or violation of these Terms.

12. Termination

12.1 By You

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period.

12.2 By Us

We may suspend or terminate your account if you violate these Terms or if required by law. We will provide notice when possible.

12.3 Effect of Termination

Upon termination, your right to use ForemanIQ ceases. Your data remains accessible for 30 days for export purposes, after which it will be deleted.

13. Dispute Resolution

Any disputes arising from these Terms or your use of ForemanIQ shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits against ForemanIQ.

14. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the updated Terms.

15. General Provisions

  • Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and ForemanIQ.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any provision does not waive our right to enforce it later.
  • Assignment: You may not assign your rights under these Terms without our consent.
